3. User Generated Content (“User Content”)
3.1. “User Generated Content” includes all content provided to the Website or to AGL for use on the Website or uploaded to the Website by users i.e. videos, clips, pictures, reviews, comments, data posting, competition entries and all other user generated material.
3.2. You are responsible for ensuring that any material you provide to the Website, including but not limited to text, photographs and sound, does not violate the copyright, trademark, trade secret or any other personal or proprietary rights of any third party.
3.3. AGL does not, unless agreed this with you separately, claim any rights of ownership in your User Content. As such, you retain all ownership rights and, although we will be able to use the User Content as set out in this Agreement, you will also have the right to use your User Content in any way you choose. Where User Content is to be used in a different way (e.g. we are asking to own this) this will be made clear on the Website and you will then be able to choose whether to provide particular User Content on that basis.
3.4. AGL does not guarantee to use or otherwise make available User Content. Any User Content may be rejected by AGL and may be edited, moderated or deleted at its absolute discretion. 9. Choice of Law and Jurisdiction
9.1. These terms and conditions shall be governed by and construed in accordance with English law. You also agree, subject to the following clause, to submit to the exclusive jurisdiction of the English courts as regards any claim or matter arising under these terms and conditions.
9.2. For the exclusive benefit of AGL AGL shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence.
10. General
10.1. These terms and conditions are the complete and entire agreement between the parties and supersede any prior terms, conditions or agreements, whether written or oral.
10.2. If any of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
10.3. Failure of either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy. If you don’t agree to the foregoing terms and conditions, please exit the Website now.
